Default Exhibition / Loan Terms
These terms apply where any artwork owned, consigned, or managed by ArtM is delivered to, collected by, installed at, exhibited by, stored by, transported by, or otherwise held by any exhibitor, venue, company, or individual, and no separate signed written agreement is in force, provided these terms were made available to the exhibitor before or at the time possession of the artwork was taken.
By taking possession of, installing, transporting, storing, exhibiting, or retaining the artwork, the exhibitor confirms acceptance of these terms.
Exhibitor Obligations
The exhibitor shall:
- insure the artwork, at its own cost, from collection or delivery until safe return, for the Agreed Insured Value notified by ArtM in writing;
- keep the artwork only at the approved venue and shall not move, sub-loan, alter, clean, restore, reframe, or otherwise interfere with it without ArtM’s prior written consent;
- maintain appropriate care, security, and environmental conditions for the artwork;
- notify ArtM immediately of any loss, theft, damage, deterioration, claim, seizure, or other risk affecting the artwork;
- provide ArtM reasonable access to inspect the artwork and its display or storage conditions on at least 24 hours’ notice during normal hours; and
- return the artwork immediately on ArtM’s written request if these terms are breached or once the agreed exhibition period ends, unless otherwise agreed in writing.
Liability
The exhibitor is liable for direct loss or damage to the artwork, and for reasonable recovery, conservation, and transport costs, to the extent caused by its breach of these terms, negligence, or failure to take reasonable care.
Priority of Signed Agreements
Where a separate signed agreement exists, that agreement prevails over these default terms.
